AGREEMENT FOR THE
DISPOSAL OF LIVESTOCK MANURE

Farmer to Farmer Sale

The following is an Agreement for the sale of livestock manure to meet the requirements of a Nutrient Management Plan.

This Agreement is made between:

Farm Owner/Operator hereafter referred to as the "Applicant"
and

____________________________________
Purchaser of Livestock Manure hereafter referred to as the "Purchaser"

WHEREAS the Applicant has prepared a Nutrient Management Plan indicating the sale of a quantity of livestock manure;

AND WHEREAS the Purchaser agrees to store and apply the livestock manure in accordance with recognized best environmental and agricultural practices;

NOW THIS AGREEMENT WITNESSETH that the parties hereto agree as follows:

  1. The Applicant has contracted to the Purchaser for disposal of _________ litres/tonnes of livestock manure.

  2. The Purchaser warrants that he/she has adequate manure storage that:

    1. Provides for the elimination or management of any liquid run-off from the livestock manure such that it is not entering a municipal drain, an open watercourse or a field tile bed.

    2. The total combined manure storage of the Applicant and the Purchaser shall meet or exceed 240 days capacity.

    3. The Purchaser's manure storage facilities satisfy manure storage guidelines published from time to time by the Ontario Ministry of Agriculture, Food and Rural Affairs.

  3. The Purchaser agrees to apply the livestock manure to the following lands (provide description and location):

  1. The Purchaser will not contract to receive manure from any other Applicant during the term of this agreement without the prior approval of the Ontario Ministry of Agriculture, Food and Rural Affairs or unless the livestock manure is to be applied to lands other than those listed above.

  2. This agreement shall be in force for a maximum period of five (5) years, or as changes occur, commencing on __________ and ending on __________.

  3. The terms of this agreement shall strictly apply to the present Purchaser. Should the Purchaser use the livestock manure for any purpose not listed in this agreement, or in a manner which is demonstrated to cause environmental harm, the agreement ceases to apply.

  4. The Purchaser is notified by this agreement that any lands within the County of Prince Edward on which the livestock manure is to be applied in accordance with this agreement, will be registered on the County of Prince Edward Planning Services Geographic Information System (GIS).
